Canada Goose sues competitor over alleged replicas

Canadian outerwear manufacturer Canada Goose Inc. is suing a competitor for trademark infringement, accusing it of making shoddy replicas of the distinctive Canada Goose parkas.

The lawsuit alleges that International Clothiers Inc., which is owned by Fairweather, has intentionally designed a logo and positioned it on jackets to mimic the Canada Goose Arctic Program design trademark.

Canada Goose is calling on International Clothiers to stop what it calls "deceptive trade practices," including publishing print ads promoting its jackets as "Canada Goose products, which they are not." But International Clothiers has allegedly done nothing more than apologize and doesn't dissuade customers from thinking they are buying Canada Goose coats.

Canada Goose filed a statement of claim late last month asking the Federal Court to stop International Clothiers from using its Canada Weather Gear and Super Triple Goose logos, "or any confusingly similar mark," which it says is very similar to its own distinctive circular logo.

That circular logo is what distinguishes a Canada Goose jacket from others, the company says.

"Canada Goose prides itself on, and has become known for, designing and manufacturing its clothing products in Canada, and ensuring that they are of the highest quality," the company writes in the statement of claim.

International Clothiers has been selling coats since December 2009 that, according to Canada Goose, feature not only a similar logo to Canada Goose, positioned in the same area of the right sleeve, but also several other similarities, including the look of the pockets.

"All of which make it highly reminiscent of a Canada Goose jackets, but of inferior quality," the company says. "While Canada Goose is a "Canadian success story," the claim says, International Clothiers "is a manufacturer and retailer of low to mid-quality clothing products," most of which aren't made in Canada, the outerwear company alleges.

The allegations have not been proven in court. A statement of defence has not yet been filed, and International Clothiers could not be reached for comment.

Canada Goose isn't yet claiming a specific amount in damages, as it writes in the lawsuit that so far only International Clothiers knows how much money has been made from the alleged infringement.

Canada Goose itself has sold more than $225 million in coats and accessories — more than 600,000 items — across Canada since 2005, court documents say. The products are sold in more than 200 retail outlets across the country, and the company says it has spent $2 million since 2005 marketing Canada Goose products in North America.

London Fashion Week Autumn/Winter 2012 Show Report: Burberry

Just as at the Oscars, the red carpet arrivals for the Burberry catwalk presentation are so spectacular that you'd be forgiven for forgetting that the parade of A-list faces and killer glamourwear is not, in fact, the main event for which we are all gathered.

There's Clemence Posey looking sexily dishevelled in a burgundy spotty blouse... There's Kate Bosworth with those bewitching mis-matched eyes in a grey owl motif jumper….There's Rosie Huntingdon-Whiteley, all pouty in a cropped tweed jacket... and Alexa Chung in a sexy black trench coat,bare legs and loafers…And there's Eddie Redmayne wearing… well, who cares? Yes, it's A-list all the way at Burbs.

So by the time the catwalk show soundtrack begins, the Burberry Prorsum Autumn Winter 2012 collection has a lot to live up to, to compete with that front row line-up. But, no worries, because next season is a killer collection from Burberry.

His polished, subtly coloured collection lived up to all expectations.

The rich metallic green and burgundy brocade dresses with prim little Peter Pan collars and coats of embossed cotton looked exactly what a smart modern girl might wear in the city – sleek, shiny and strictly tailored. Peter Pilotto's futuristic collection of Asian- inspired graphics on quilted bomber jackets and wavy hemmed skirts was a busy conglomeration of contrast prints.

Sporty touches extended to cutaway velvet dresses with racer backs, though multicoloured fox fur bibs and sequined embellishment felt forced rather than easy-going. Notable were the elegant border printed ribbon shoes.

It is a good strategy. To some owners' chagrin, today's fans are pretty bright. They realize that there are plenty of free agents out there every year and that a sharp general manager can make a few savvy trades and smart buys and turn a team around in a hurry. It might be preferable to develop your own prospects and build through the draft, but it can be done the other way, too.

No one wants to start over. Most fans would rather have a reason to hope and end up disappointed than start a season with no hope at all. They would almost always trade possible success three years from now for possible success now.

Reds manager Dusty Baker has managed teams in both situations, which is why he was smiling when the first wave of players rolled in on Sunday.

"Nothing is better than when you know you've got some good troops," Baker said.

And nothing is worse than starting a season with "troops" that you know have no chance to reach the postseason.

Preview: Alexandra Owen winter '12

Wellington-based fashion designer Alexandra Owen has created a fresh new silhouette for winter 2012 - and a renovation of her store shows it off in style.

Owen's shift in design direction, which challenges traditional notions of the female silhouette, was inspired by her visits to New York last year.

"It has been a big shift this season. In New York I was seeing the street culture, looking at the way women wear clothing, looking at how it ties into their lifestyle, and most importantly - being a customer again for the first time in ages" she said.

"As a collection I wanted it more pared back, less pretentious, with a woman's lifestyle in mind".

Mid-century couture shapes were a starting point for the new season's look, with 'S' curved backs, accentuated necklines and an unusual dropped sleeve. While the shoulders and neckline are seemingly the focus point of most of the garments, they draw the eye in to focus on a defined waist, giving off a somewhat equestrian and regal silhouette.

"I'd wanted to achieve a beautiful 'S' curve throughout the back of my jackets for a while. I wanted to get that interesting shoulder silhouette without doing a leg of mutton sleeve or anything that felt dated. I ended up taking a 1950's inserted sleeve and making it a bit more modern, a bit more severe than the original vintage shape" she said.

Owen's passion for her craft and endless pursuit of perfection lends the brand airs of a couture design house and her new store feels like a gallery of carefully curated garments.

"While the old store was charming and intimate, this season's collection was bigger,canada goose jackets and I wanted the garments to be enjoyed without it feeling cluttered. I like the clothes to have room to breathe, and I try to lay it out so you can look at a piece and see how it works into outfits on the rack."

'At no time are the geese live-plucked for their down. Along with banning live-plucking, force feeding - for foie gras - has been banned in the supply chain of The North Face down material for many years.'
With a very different story emerging, many North Face buyers will undoubtedly be rethinking their position.
One, 33-year-old Jane Daley, said she would now feel uncomfortable wearing the down ski jacket she bought from The North Face last year.

AMISH COOK: Taking care of sick child emphasizes blessings

It's a little past 7 a.m. and the bright glow in the eastern sky looks like a promise for a sunny day. The sun is always welcome at this time of the year. The ground is covered with snow again and the temperatures are colder. Finally feels like winter. Saturday morning our thermometer showed 6 degrees. The last few days the morning temperature has been around 20. The new stove is heating well and is saving us coal. It was high time for a new one.
I am making coffee. I don't drink coffee every morning but it feels like I need some this morning. I was up with daughter Lovina, 7, during part of the night. Tibi Fall 2012 Collection

Gary Bettman believes in Blue Jackets

NHL commissioner Gary Bettman says he is aware of how frustrated Columbus Blue Jackets fans are about another losing season.

He is also certain that the franchise has the right people in charge to turn the sorry club around.

"I'm aware of the fact that there's a little bit of frustration by some fans in the on-ice performance," he said of the Blue Jackets, 15-32-6 heading into Thursday night's game against Dallas. "I can assure you, because I know it firsthand, there is nobody more frustrated than ownership and management. And nobody more committed to getting it right on the ice than ownership and management. I have no doubt about the future of this franchise because it's in extremely strong, committed hands."

A few hundred Blue Jackets held a rally recently to protest the club's front office, which has overseen a terrible season. The team faltered at the start and hasn't recovered. The Blue Jackets entered their most recent game with just 36 points -- 11 behind Edmonton, the team with the next-worst record.

Bettman has chosen to view the angry fans as a plus.

"I saw that somebody was trying to organize a pep rally. But that's a good sign," joked the commissioner, who is often met with jeers when introduced at games to make on-ice presentations. "It's kind of like when you get booed when you go out on the ice, it's better than when it's quiet. I know about that firsthand."

Columbus was recently awarded the 2013 NHL All-Star Game. The Blue Jackets, who hosted the draft in 2007, are averaging 14,526 spectators per game this season and 16,236 over their 11 seasons.

Earlier Thursday, Bettman was in Detroit for the announcement of next year's Winter Classic. The game between Original Six rivals, the Detroit Red Wings and Toronto Maple Leafs, is expected to draw around 115,000 to Michigan's "Big House."

Bettman was asked if Columbus might someday host a Winter Classic game at 105,000-seat Ohio Stadium.

"We just did the All-Star Game," he said with the laugh. "You want more right now?"

Bettman declined to discuss proposed conference realignment, which would most benefit teams such as Detroit and Columbus -- the only Eastern time zone teams in the Western Conference. The NHL Players' Association refused to allow the league to implement the new alignment.

"This league has had 13 different types of alignment and scheduling in the regular season since 1966. 'Handsome Femininity' From Richard Chai

Richard Chai's collection was late arriving at Lincoln Center for his 11 a.m. fashion show this morning, so while the editors were waiting, they checked their e-mail. At 11:12 a.m., a press release popped in my in-box from Pantone, the color forecasting company, announcing its predictions for the fall season: Olympian Blue, Tangerine Tango, Ultramarine Green, Titanium, Honey Gold, Pink Flambé and other colors that I can't quite picture but assume to be rather bright.

When Mr. Chai's designs hit the runway, they were, as usual, predominantly based in urban shades of grays, blacks and navy blue.canada goose parka I suspect Pantone's report is mostly a public relations stunt to get its name in the papers. (It works.) But I mention this as a reminder that New York Fashion Week, with something like 350 shows, cannot easily be pegged to a set of trends for the season. "I didn't want to do anything that was tricky," Mr. Chai said. "I didn't want to create looks that were just for the show. I wanted it to be approachable and believable, but also be really aspirational. At the end of the day, it's pieces that I want people to wear."

Mr. Chai's gray and black blanket stripes were shown on coats, jackets and trousers for men and women, and later in his show there were sportswear options in claret velvet, wide-legged corduroy pants, and a print that looked like old wallpaper, but no Tangerine Tango. For men, he also introduced his new collection for Filson, including coats, a weekender bag and backpacks trimmed with the company's signature thin leather strips.

The idea, Mr. Chai said backstage, "was obviously the idea of youthful uniforms and a fun way to put things together, but also, for women at least, handsome femininity."

'Jackets edge conference rivals

After suffering back-to-back losses on Jan. 27 and 29, the men's basketball team appeared vulnerable. They had lost five of their last seven games, all to University Athletic Association rivals, and all on the road. The two most recent defeats came at the hands of midwest powers, as the No. 25-ranked Washington University in St. Louis Bears did away with the 'Jackets, 83-78 in Missouri, and two days later, the University of Chicago Maroons edged the visitors, 96-92.

Yet for the Yellowjackets, there truly is no place like home. Undefeated at the Palestra this winter and having won two early-season tournament titles in Rochester (the Chuck Resler Tournament and the UR/Holiday Inn Airport Tournament), the team sought to continue their home-court dominance and snap their losing streak this past weekend. Suitably, it was the same two foes — the Bears and the Maroons — who would challenge the 'Jackets on Friday, Feb. 3 and Sunday, Feb. 5, respectively.

Junior John DiBartolomeo, the reigning UAA player of the year, paced a superior UR shooting effort that saw five Yellowjackets reach double figures in the game against Wash U. DiBartolomeo's 27 points were a game-high, and the guard also dished out eight assists — most of them to sophomore Nate Vernon (19 points), senior Nate Novosel (11 points), freshman Kevin Sheehy (11 points) and junior Rob Reid (10 points) — to create a well-balanced attack the Bears simply couldn't fend off. The 'Jackets shot an impressive 53 percent from the floor in the first half and an even more astounding 64 percent from the three-point range to put the home team up by 11 at halftime.

The UR attack continued to run up the scoreboard early in the second half. Two free throws by senior Marcus Williams capped a run that stretched the 'Jackets lead to 20, to the roar of a legion of yellow and blue-clad fans. Wash U. responded with a 10-2 run of its own, which brought the Bears to within seven points. That did not matter, though, as three UR players sank free throws to put the lead out of the visitors' reach.

The Yellowjackets carved out a second win during the weekend in a similar fashion when they played host to the Maroons. The home team took early control of the game, building a nine point cushion on the heels of a 13-2 run that put the 'Jackets up, 17-8, early in the first half. The teams swapped blows for the remainder of the half, with the 'Jackets' lead slowly growing to 13 by halftime (38-25). The story of the 'Jackets' game up to that point, however,canada goose parka wasn't in their offensive exploits, but their defensive ones. The home team had succeeded in holding Matt Johnson, the lead scorer in the conference, to a measly two points in the first half.

In a last-ditch effort to claim the game, the Maroons chose to put their faith in the talented Johnson. His attempted hurl at the buzzer from beyond half court missed, however, giving the 'Jackets the win.

The men's team has now won 17 straight regular season home games, as well as 13 straight against UAA opponents at the Palestra — a streak dating back to the 2009-10 season. The team will face a true test on Friday, Feb. 10, when they host Brandeis University, who fended off the 'Jackets 78-64 earlier this season.
